FEC approves revision of Statement of Organization form

WASHINGTON – At its open meeting today, the Federal Election Commission approved a motion instructing agency staff to revise the form by which political committees register with the Commission. The Commission held over consideration of an advisory opinion request to a future meeting.

Motion to Instruct Staff to Prepare an Amended Form 1. The Commission approved a motion proposed by Chairman Allen Dickerson that instructs agency staff to revise FEC Form 1 (Statement of Organization) to allow a committee to file as an independent expenditure-only political committee (i.e., Super PAC) or a committee with a separate non-contribution account (i.e., Hybrid Committee). Currently, these committees can designate themselves as Super PACs or Hybrid Committees with the Commission only by filing a separate letter in addition to a Statement of Organization. The Commission’s motion directs agency staff to complete the amended version of the form by February 14 for the Commission’s review and adoption.

Advisory Opinion Request 2021-13 (Matthew Hoh). The Commission held over consideration of this advisory opinion request to a future meeting. The requestor, a combat veteran who receives disability compensation from the Veterans Administration, intends to run for U.S. Senate in the 2022 election cycle and asks whether his disability compensation constitutes “earned income” for purposes of the Commission’s candidate salary regulation at 11 C.F.R. § 113.1(g)(1)(i)(I).

The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House of Representatives, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.
