Comments sought on amending regulation to include deliberately deceptive Artificial Intelligence in campaign ads

On August 16, 2023, the Commission published a notification of availability in the Federal Register at 88 Fed. Reg. 55606 that seeks public comment on a petition for rulemaking filed by Public Citizen.

The petition asks the Commission to amend its regulation at 11 CFR 110.16 that prohibits a candidate or their agent from fraudulently misrepresenting other candidates or political parties. The petitioner requests that the Commission amend its regulation to make it clear that the related statutory prohibition applies to deliberately deceptive Artificial Intelligence campaign advertisements.

Public comments on the petition are due by October 16, 2023. Commenters are encouraged to submit comments electronically (reference REG 2023-02) via the Commission’s website.
