Civil penalty program for late or non-filed FEC reports extended to 2023
On December 21, 2018, President Trump signed legislation (H.R. 7120, Pub. Law No. 115-386) that officially extends the Commission’s Administrative Fine Program for late- and non-filed reports for an additional five years.
The Administrative Fine Program assesses civil money penalties for late and non-filed reports. Fines are established by a pre-existing formula. The new law extends the program to apply to federal campaign finance reports covering periods that end on or before December 31, 2023. The Commission recently published its civil penalties for fines under the program for 2019.
Most reports that political committees file are covered under the Administrative Fine Program. This includes semi-annual, quarterly, monthly, pre-election, 30-day post-general and special election reports, as well as 48-hour notices of last-minute contributions received by authorized committees.
